Sales Policy:

The LifeChoice portable oxygen concentrator may be purchased directly by the consumer/patient with a prescription and any USA Visa, MasterCard, American Express or Discover credit or debit card in USA dollars. Both a USA credit card billing address and a USA shipping street address for the LifeChoice POC will be required. Sorry, no checks or COD orders or international orders.

Shipping options will be UPS or Federal Express (as determined by Inova Labs Inc.) via ground or overnight shipment (customer's choice) to a USA street address. Delivery signature will be required for all shipments.

The LifeChoice POC is a prescription required medical device. A doctor or the patient may fax or email the appropriate doctor's prescription for supplemental oxygen use in the patients name to staff@lifechoiceoxygen.com or fax to 1-512-326-3299. Please make sure the LifeChoice POC order number is included on or with the prescription since the patients name and purchaser's name might be different. Your order number will be confirmed to you via email or phone operator when you place your order with Inova Labs Inc. for a LifeChoice POC and the order is confirmed. The LifeChoice POC Mobility Package cannot ship until the doctor's prescription is received by Inova Labs Inc. with the corresponding order number.

The LifeChoice POC comes with a 30-day money back guarantee less shipping/handling charges if applicable. During that 30-day period after receipt of product, if you decide to return the LifeChoice POC simply email to staff@lifechoiceoxygen.com or call the toll free number and request a Return Authorization Number. Please make sure you have your original order number and date of receipt when you contacted Inova Labs Inc. to order a LifeChoice POC. Please write your assigned Return Authorization Number on the box and on a sheet of paper inside the box. Then, ship the LifeChoice POC, freight pre-paid, to the address provided. Once the complete LifeChoice POC Mobility Package is received in proper working order, your refund will be processed. Please allow 30 days for the refund process to transact.

Once your prescription is received, your LifeChoice POC will ship within 3 business days. The 30-day money back guarantee begins upon receipt of the LifeChoice POC.

LIFECHOICE BY INOVA LABS LIMITED 3 YEAR WARRANTY:

Limited Warranty:

Inova Labs Inc. (Inova Labs) warrants that each new LifeChoice Portable Oxygen Concentrator shall be free from defects in materials and parts under normal use and operation and when correctly maintained for (3) three years. Any LifeChoice POC accessories, the sieve bed and all batteries are warranted for (1) one year.

Purchaser agrees to operate the Product in accordance with the LifeChoice operating manual instructions as provided and that failure to do so shall void this limited warranty. Each item of equipment for which warranty claim is asserted shall be returned on a prepaid basis with proof of purchase date to Inova Labs, properly packaged, at the expense of the purchaser. The purchaser will be responsible for all return freight charges. Any returned product must be properly identified by a Return Authorization Number issued by Inova Labs. Products returned without a Return Authorization Number will be refused and returned to purchaser at purchaser's expense. Inova Labs shall pay for regular shipment back to the purchaser for repairs or replacements of product under warranty.

This limited warranty doest not apply to: normal routine service items; repair or replacement of parts/equipment necessitated by misuse, accident, improper maintenance, abuse or repairs/alterations made by persons other than Inova Labs or persons not expressly authorized in writing by Inova Labs prior to any repairs/alterations; defects caused by the effects of normal wear and tear; Acts of God or other causes not within the control of Inova Labs.

The sole and exclusive remedy for any defect is limited to repair or replacement of the defective part or product, or refund of the purchase price at the sole discretion of Inova Labs. This limited warranty is exclusive and in lieu of all other warranties or representations, expressed, or implied, either in fact or by operation of law, statutory or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. No representation or statement of Inova Labs may change or alter this limited warranty.

Inova Labs shall have no further liability for damages, losses, cost or fees of any kind or nature, whether foreseeable or not, including but not limited to attorney's fees and consequential, general, special, incidental, indirect, exemplary or punitive damages, regardless of the form of any claim, whether in contract, tort, or otherwise, arising out of or related to the use of Inova Labs products even if Inova Labs has been advised of the possibility of such damages, losses, cost or fees. Inova Lab's liability for loss or damages shall not exceed the purchase price paid for the particular product.

Any claims for breach of this limited warranty shall be governed by Texas law and must be brought in a state or federal court in Texas.
